Under the Data Protection Act 2018 it gives living individuals the right to request access to a copy of their personal records. This is commonly referred to as a subject access request or ‘SAR'.
The Access to Health Records Act 1990 (AHRA) deals with the disclosure of deceased persons’ records. Under the AHRA when a person dies, their personal representative, executor, administrator, or anyone having a claim resulting from the death, has a right to apply for access to the deceased’s records.
Subject Access Requests
Requests to see records and other related information about yourself are know as 'Subject Access Requests'. You have a right to get a copy of the information that is held about you.
Who can request this information?
- The named individual
- Personal representative e.g Power of Attorney
- Parent/Legal Guardian
Access to Health Records
The Access to Health Records Act 1990 grants rights to certain individuals to see what has been written about a deceased patient in a hospital and other health records.
Who can request this information?
• The patient’s personal representative (this will be the Executor of the Will or the Administrator of the estate)
• Any person who may have a claim arising out of the patient’s death
This can take up to 40 days to process and the trust will not make a charge for the request. This only applies to written records made on or after 1st November 1991.
How to make a request?
To make a request for personal information please complete the Request for Personal Information Form
Your request will be received centrally in the Information Governance Team. It will then be allocated to Data Protection Liaison Officers within our services to process the request.

GP Records
If you want your GP records then you need to contact your practice directly. If you have been de-registered (e.g. you have emigrated) you will need to apply to your area's local Integrated Care Service, e.g. Shropshire, Telford and Wrekin ICS as they hold the records in their archive.
